Abstract
Mahkamah Syar'iyah Lhokseumawe sebagai lembaga peradilan Islam mempunyai kewenangan untuk
memeriksa, mengadili dan memutuskan perkara pelanggaran Qanun Syari 'at Islam Nomor 13 Tahun 2003
tentangmaisir (perjudian). Di wilayah hukumMahkamahSyar 'iyah Lhokseumawe, masih terjadi pelanggaran
terhadap jarimah maisir di mana perkara tersebut sudah mempunyai kekuatan hukum tetap, tetapi putusan
tersebut belum dapat dieksekusi. Adapun hambatan eksekusi diakibatkan oleh faktor yuridis yaitu materi
qanun belum lengkap, adanya asaspersonalitas, panjangnya birokrasi dan tidak berfungsinya hakim wasmat.
